Fanomix is an AI-powered platform for creating video advertisements. It is operated by Fanomix, LLC, a Delaware limited liability company ("we", "us", or "our"). By creating an account or using the platform you agree to these Terms of Service ("Terms").
You must be at least 18 years old to use Fanomix. By registering you confirm that you meet this requirement. We may suspend or terminate accounts where we have reason to believe this condition is not met.
You are responsible for keeping your login credentials secure and for all activity that occurs under your account. Notify us immediately at support@fanomix.com if you suspect unauthorized access. We reserve the right to disable accounts at our discretion.
Access to AI generation features is governed by a credit system. Credits are consumed when you run workflows such as image generation, video generation, and voiceover synthesis. The credit cost of each action is displayed before you confirm it.
Credits are non-refundable except where required by applicable law. We reserve the right to adjust pricing with reasonable notice. Unused credits do not expire unless your account is terminated for breach of these Terms.
You agree not to use Fanomix to:
We may suspend or terminate your account and retain any unused credits if we determine you have violated this section.
You retain ownership of the creative briefs, scripts, and other inputs you provide. You grant us a limited licence to process that content solely to deliver the service. We do not claim ownership of output videos or images you generate.
You are solely responsible for ensuring your use of generated content complies with applicable laws, including advertising standards, intellectual property law, and platform policies of any third-party service where you publish the content.
Fanomix uses third-party AI services to process your requests, including OpenAI, Replicate, ElevenLabs, and KlingAI. Your inputs and generated outputs may be processed by these providers subject to their own terms. We do not guarantee specific output quality, style, or accuracy.
We aim to maintain high availability but do not guarantee uninterrupted service. We may suspend the platform for maintenance, updates, or circumstances beyond our control. We are not liable for losses arising from downtime.
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT GENERATED CONTENT WILL BE ACCURATE, SUITABLE FOR ANY PARTICULAR PURPOSE, OR FREE FROM THIRD-PARTY CLAIMS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FANOMIX, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR CREDITS IN THE THREE MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Fanomix, LLC and its officers, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the platform, your content, or your violation of these Terms.
We may update these Terms from time to time. We will notify you by email or via the platform at least 14 days before material changes take effect. Continued use after that date constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Sussex County, Delaware.
